1. ACCEPTANCE OF TERMS By accessing the Aurotracker website, purchasing our hardware, or using the associated mobile applications (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Services.
2. IMPORTANT: WELLNESS & NON-MEDICAL USE AGREEMENT Aurotracker devices are "General Wellness" products, NOT medical devices.

Lifestyle Aid Only: The hardware and software are provided to help you track general wellness trends (such as activity, sleep, and estimated vital signs). They are not intended to replace professional medical hardware, clinical diagnosis, or the advice of a licensed physician.

Consult Your Doctor: You agree to consult with a qualified medical professional before relying on any data provided by the Services, especially if you have a pre-existing condition.

Sensor Limitations: You acknowledge that optical sensors in consumer wearables have inherent limitations. Variance in readings due to motion, skin pigmentation, or fit is normal and does not constitute a "manufacturing defect."
3. YOUR ACCOUNT & SECURITY To use certain features of the App, you may be required to create an account.

Responsibility: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Notification: You agree to notify us immediately of any unauthorized use of your account.
4. RULES OF CONDUCT You agree to use the Services responsibly and lawfully. You will not:

Upload Harmful Content: Transmit viruses, malware, or illegal content.

Harass Others: We have a zero-tolerance policy for hate speech or bullying.

Tech Abuse: Attempt to interfere with our servers, "scrape" data, or reverse-engineer our code.

Violate Privacy: Use the tracker to monitor another person without their express consent.

Enforcement: We reserve the right to suspend your account if you violate these rules.
5. SHIPPING & DELIVERY

Shipment Contract: All hardware purchases are made pursuant to a shipment contract. This means that the title and risk of loss pass to you upon our delivery of the goods to the shipping carrier.

Delivery Issues: While we are not liable for delays caused by the carrier (USPS, UPS, etc.), we will assist you in filing claims for lost packages to the best of our ability.
6. WARRANTY & RETURNS (ALIGNMENT WITH REFUND POLICY)

30-Day Satisfaction Guarantee: As outlined in our [Refund Policy], you may return items within 30 days of receipt in like-new condition for a refund.

Limited Hardware Warranty: We provide a limited warranty against manufacturing defects for 30 days from the date of delivery.

Exclusions: This warranty covers defects in materials and workmanship. It does not cover:

Damage caused by accidents, abuse, or misuse.

Water damage resulting from exceeding the device's water resistance rating (e.g., swimming with a splash-proof only model).

Normal battery capacity depletion over time.

Software "As-Is": App features and firmware are provided "As-Is." We do not warrant that the software will be error-free or that specific features will work with every phone model.
7. INTELLECTUAL PROPERTY & FEEDBACK

Ownership: The Services, including all code, designs, and trademarks, are owned by Aurotracker.

Feedback: If you submit ideas or suggestions to us, you agree that we can use them to improve our products without restriction or compensation.
8. COPYRIGHT POLICY (DMCA) We respect intellectual property. If you believe content on our site infringes your copyright, please contact us at support@aurotracker.com. We will address claims in accordance with the Digital Millennium Copyright Act (DMCA).
9. THIRD-PARTY LINKS & APPS Our Services may integrate with third-party apps (like Apple Health or Google Fit). We are not responsible for the content or privacy practices of these third parties. Accessing them is at your own risk.
10. INDEMNIFICATION You agree to defend and hold harmless Aurotracker, its officers, and employees from any claims, damages, or expenses (including legal fees) arising from:

Your breach of these Terms;

Your violation of any third-party rights.
11. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Aurotracker’s total liability for any claim arising out of the Services shall not exceed the amount you paid for the product.

No Consequential Damages: We are not liable for indirect, incidental, or consequential damages (including medical claims or data loss) arising from your use of the Services.
12. EXPORT CONTROL You agree to comply with all applicable export laws. You represent that you are not located in a country subject to a U.S. government embargo.
13. DISPUTE RESOLUTION & ARBITRATION PLEASE READ CAREFULLY:

Binding Arbitration: All disputes arising from these Terms shall be resolved via binding individual arbitration in the State of Nevada.

Class Action Waiver: You waive your right to a jury trial and your right to participate in a class-action lawsuit.
14. ELECTRONIC COMMUNICATIONS

Consent: You agree to receive communications from us electronically (email/app).

Marketing: By entering your email on our site, you consent to receive promotional materials. You may opt-out at any time by clicking "Unsubscribe."
15. CHANGES TO TERMS We may modify these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice. Your continued use of the Services constitutes acceptance of the new Terms.
16. GENERAL PROVISIONS

Force Majeure: We are not liable for failures caused by events beyond our control (natural disasters, war, etc.).

Severability: If any part of these Terms is unenforceable, the rest remains in effect.

Entire Agreement: These Terms (along with our Privacy and Refund Policies) constitute the entire agreement between you and Aurotracker.
