1. IMPORTANT HEALTH & SAFETY DISCLAIMER

PLEASE READ: AUROTRACKER IS A GENERAL WELLNESS DEVICE.

FDA NOTICE: The health tracking features of Aurotracker devices—including Blood Glucose Trends, Blood Pressure Estimates, Heart Rate, and SpO2—are not FDA-cleared or approved medical devices. They are intended for general wellness and lifestyle tracking only.

  • NOT FOR DIAGNOSIS: These features must never be used as a replacement for professional medical equipment (such as a clinical glucometer or blood pressure cuff). Do not use this data to diagnose diabetes, hypertension, or any cardiac condition.

  • MEDICATION SAFETY: Never adjust your medication, insulin, or dosage based on data from this watch. Always consult your doctor.

  • ACCURACY LIMITATIONS: As optical consumer electronics, readings can be affected by motion, device fit, skin pigmentation, and temperature. Always verify abnormal readings with a clinical-grade device.

  • CONSULTATION: Always consult a physician before acting on any data. Reliance on Aurotracker data for medical decisions is at the user's sole risk.

2. YOUR HEALTH DATA PRIVACY

We respect that your health data is personal. We adhere to the strictest standards of consumer privacy to protect your information:

  • LOCAL PROCESSING: Your vital sign data (like Heart Rate, Sleep, or Activity) is processed locally on your device and the paired app to provide your daily insights.

  • NO SALE OF HEALTH DATA: We strictly do not sell your health or biometric data to insurance companies, data brokers, or advertising networks. Your health journey is yours alone.

  • DATA "AT REST": Your detailed minute-by-minute health metrics remain on your local hardware. Aurotracker does not store your continuous vital signs on our central servers.

3. SHOPPING & SERVICE DATA (THE "SHOPIFY" LAYER)

We use Shopify to power our secure online store. When you purchase an Aurotracker, we collect:

  • Contact & Shipping: Name, Address, Email, and Phone Number.

  • Financials: Payment details are processed through secure, encrypted gateways (Shopify Payments/PayPal). We never store your full credit card numbers.

  • App Permissions: To use smart features like "Call/Message Reminders," the app requires Bluetooth and Notification access. We do not access or store your private text content or call logs.

4. MARKETING & COMMUNICATIONS CONSENT

By entering your email address in our newsletter subscription form, footer, or at checkout, you provide express consent to the following:

  • Purpose: We will use your email to send promotional materials, product updates, and marketing communications.

  • No Third-Party Sale: We do not sell your email address to third-party data brokers. We only share it with necessary service providers (e.g., email platforms) to facilitate our own marketing.

  • Opt-Out Rights: You may withdraw your consent at any time by clicking the "Unsubscribe" link in any marketing email. Your request will be processed within 10 business days as required by law.

5. COOKIES & TRACKING TECHNOLOGIES

To improve your experience and run our store efficiently, we use cookies, pixels (such as the Meta Pixel), and similar tracking technologies.

  • Functionality: These technologies allow us to remember your cart and preferences.

  • Analytics: We use tools to analyze site traffic and user behavior. By using our website, you consent to this data collection.

  • Do Not Track Signals: Currently, our systems do not respond to browser "Do Not Track" signals, except where required by Global Privacy Control (GPC) laws.

6. BINDING ARBITRATION & CLASS ACTION WAIVER

LEGAL NOTICE: By purchasing or using Aurotracker, you agree that any dispute—including claims regarding the accuracy of health sensors or data privacy—shall be resolved through Binding Individual Arbitration in the State of Nevada, and shall be governed by the laws of that jurisdiction.

YOU HEREBY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR A JURY TRIAL.

7. AGE REPRESENTATION

Aurotracker is a general audience product. By purchasing, you represent that you are at least 18 years of age. If you are a parent allowing a minor to use the device, you assume all liability for their data and the "Medical Disclaimer" above. We do not knowingly collect data from children under 13.

8. YOUR GLOBAL DATA RIGHTS

Regardless of your location, you have the following rights:

  • Access & Portability: Request a copy of the data we hold.

  • Correction: Fix inaccurate shipping or account info.

  • Deletion: Request we "forget" your order history, subject to tax/legal record-keeping.

  • Opt-Out: You may opt-out of marketing emails at any time.

9. CONTACT & BREACH NOTIFICATION

In the unlikely event of a data breach involving your personal information, we will notify you within the timelines required by federal and state laws.
